VERDICTS and SETTLEMENTS
In one case, during the course of prenatal care an obstetrician
(after noting the likelihood of a premature birth) the doctor
failed to provide proper treatment for the mother in anticipation
of this likelihood. Born prematurely, the child suffered from
Cerebral Palsy and severe brain damage. The case was litigated by
current Oshman & Mirisola Attorney John Langell. The jury
returned a medical malpractice verdict for $10,500,000.00.
In another case, Oshman & Mirisola negotiated a
$4,900,000.00 pretrial settlement for an infant plaintiff who
sustained severe brain damages as the result of an automobile
collision.
In yet another matter, an expectant mother was diagnosed as
suffering from gestational diabetes and the fetus was known to be
approximately 9 pounds, 6 ounces. Despite these facts, a vaginal
delivery was attempted. At the time of delivery, the newborn's
shoulder became stuck behind the cervix of the mother. Rather than
perform a Cesarean-section, the obstetrician utilized an improper
delivery technique, causing a brachial plexus injury known as an
