Kentucky DUI Law - Information

You can be arrested for DUI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Kentucky DUI penalties:

First Offense

• a fine of no more than $500.00
• possible term of imprisonment of no more than 30 days
• 90 day alcohol or substance abuse program
• possible term of commmunity service for no more than 30 days
• license suspension for no more than 120 days

Second Offense

• a fine of no more than $500.00
• possible term of imprisonment of no more than 6 months
• 1 year alcohol or substance abuse program
• possible term of commmunity service for no more than 6 months
• license suspension for no more than 18 months

Third Offense

• a fine of no more than $1,000.00
• possible term of imprisonment of no more than 12 months
• 1 year alcohol or substance abuse program
• possible term of commmunity service for no more than 12 months
• license suspension for no more than 36 months
