You can be arrested for DUI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Colorado DUI penalties:

First Offense

  • a fine of no more than $500.00
  • license suspension for 4 months
  • no more than 48 hours of community service
  • alcohol education classes

Second Offense

  • a fine of no more than $1,000.00
  • possible jail time of no more than 1 year
  • no more than 96 hours of community service
  • license suspension for 1 year
  • alcohol assessment

Third Offense

  • a fine of no more than $1,000.00
  • license suspension for 1 year
  • possible jail time of no more than 1 year
  • alcohol assessment
  • attend 86 hours of alcohol therapy
  • possible seizure and sale of your vehicle
