Massachusetts DWI Law - Information


You can be arrested for DWI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Massachusetts DWI penalties:

First Offense

  • a fine of no more than $5,000.00
  • not more than 2 1/2 years House of Correction
  • license suspension for 1 year
  • participate in a self help class

Second Offense

  • a fine of no more than $10,000.00
  • possible term of imprisonment of no more than 2 1/2 years
  • license suspension for 2 years
  • Interlock device installed in your car at your own expense for 2 years
  • 14 day confined treatment program paid for by the defendant

Third Offense

  • a fine of no more than $15,000.00
  • possible term of imprisonment of no more than 5 years
  • license suspension for 8 years
  • possible seizure and sale of your vehicle
