When negotiating a franchise agreement, a skilled franchise consultant can help negotiate good terms for the franchisee—the person or business buying the franchise rights. Often, a franchise consultant will have experience in buying and running a franchise business personally. In addition, a franchise consultant may be able to review the franchise law of the state in which the franchise will be operated to ensure compliance by the franchisor—the person offering the franchise for sale. However, not all franchise consultants will have this legal expertise. For example, a franchise consultant who is not an attorney may not be able to assist the franchisee in setting up the business operation itself, hiring employees, gaining any necessary financing and establishing the underlying business entity that will buy the actual franchise.
