Part of the increase in the use of this information relates to studies done showing that people with certain thins in their past history may be unreliable employees or tenants. In the realm of employment law, however, employers need to be careful about the information they obtain or use in determining whether or not to hire someone. Much of the data a company could access from background checks is illegal for them to rely upon in determining whether or not to hire a person. Financial information is ok, but information about sexual orientation, religious affiliation or health records is often prohibited and can be the basis for a discrimination lawsuit.
