Pursuant to N.M. Stat. Ann. §§50-4-4 and 50-4-5, when an employee is fired, the employer must give him or her a final paycheck no later than five (5) business days following the date of the employee’s termination. If, however, the employee is paid by the piece, by the task, or on commission, then the employee has ten (10) business days following the date of the employee’s termination in which to issue the final paycheck.
