What are the rules on final paychecks in New Mexico?

Generally, an employer must issue a final paycheck to a former employee within five (5) days of the employee’s discharge if a definite, fixed amount of wages is owed. However, if the employee is paid by piece, by task, or on commission, the employer has up to ten (10) days from the date of termination within which to issue a final paycheck to the employee. If an employee quits his or her job, the employer need not issue the former employee a final paycheck until the next regularly scheduled pay date.
