Fundamental Constitutional Rights

While all constitutional rights are important, some are considered fundamental. If a conflict develops over a fundamental constitutional right, you are entitled to a greater degree of judicial protection. In general, the rights that are considered to be fundamental include: The Right to Move Freely Around the Country; The Right to Privacy; The Right to Make Contracts; The Right to Equal Protection Under the Law The Right to Vote The Right to Marry and Have Children The Right to Own Property The Right to Keep and Bear Arms The Right to Your Own Thoughts or Beliefs; and The Right to Associate with Whom you Please. In addition to these rights under federal law, individuals may have rights under state laws that can be considered fundamental. If fundamental rights are violated, a person has important remedies available under the law and may be entitled to compensatory damages.
