What are the rules on final paychecks in Montana?

Generally, under Montana Code Ann. § 39-3-205, an employer must immediately issue a final paycheck to a terminated employee, within four (4) hours or the end of the business day, whichever occurs first, unless the employer has a preexisting written policy to the contrary. However, that written policy may not extend the time for payment of a final paycheck to a terminated employee beyond the next regularly scheduled pay date or fifteen (15) calendar days, whichever occurs first.   An employee who quits his or her job is not entitled to a final paycheck until the next regularly scheduled pay date, or fifteen (15) calendar days, whichever occurs first.
