Am I Liable To My Neighbor If His Animals Are Injured While Trespassing On My Land?
It depends. If you intentionally injure the animals that have trespassed on your land you will be liable to your neighbor for those injuries to his animals. Additionally, you may be liable to injuries caused to trespassing animals if those injuries can be attributed to your own negligence. However, if an animal trespasses on your land and is injured as a result of no wrongdoing on your part you will not be liable to the owner. You may also be liable for injury to your neighbor’s animals if you fail to fence in any portion of your land which may be dangerous for those animals, and those animals are injured as a result of such failure.
