What Public Notice Requirements Are There For a Real Estate Foreclosure in Arizona?

Several methods of public notice are required prior to a non-judicial foreclosure in the state of Arizona. First, the lender must record a Notice of Sale in the county office where the property’s land records are recorded. Second, the Notice of Sale must be published weekly for four consecutive weeks in a widely distributed newspaper in the county where the property is located. The final publication of the Notice of Sale must be at least 10 days prior to the foreclosure sale. Finally, at least 20 days prior to the foreclosure sale, the Notice of Sale must be posted on the property being foreclosed upon and at the county courthouse. 
In a judicial foreclosure, public notice is provided when the lender initiates a court action to foreclose on the property and in any manner ordered by the court.
