Toxic torts refers to lawsuits over injuries from health hazards. You’re familiar with the famous example of “Erin Brockovich,” wherein PG&E was forced to compensate the victims who sustained injuries from its toxic dumping practices. Unfortunately, the number of toxic substances in our communities has grown tremendously over past years, including from exposure to paint, asbestos, pesticides, landfill waste, fire retardants, radiation, pollutants and contaminants, and even toxic mold. Also, we don’t usually catch on to the health hazards of certain chemicals or pollutants until a number of people get sick and ties to the relevant chemicals can be proven.
