Discovery is a phase in litigation that occurs prior to trial. During the discovery process each party has an opportunity to obtain information from the opposing side. The information requested must be believed to lead to admissible evidence pertinent to the case. Information may come in the form of depositions, interrogatories, requests for production of documents, or requests for admissions from a party. A deposition is an out-of-court statement by a witness or party that is reduced to a transcript that may later be used at trial. Interrogatories are set of formal written questions sent from one party to another in order to clarify a fact or piece of information pertinent to the case.
