Interference with prospective business advantage is an intentional tort whereby the tortfeasor intentionally interferes with and prevents the formation of a valid contractual or business relationship between the plaintiff and a third party. In order for the plaintiff to prevail, they must be able to show the existence of a valid contractual relationship or valid business expectancy between themselves and a third party. They must also prove that the defendant was aware of the contractual relationship or business expectancy and intentionally interfered with it, causing damages to the plaintiff. A common example of this intentional tort is when an individual makes false allegations against an individual’s reputation in order to interfere with and prevent a business relationship.
