In every professional industry there are a few bad apples who, unfortunately, have the ability to spoil the reputation of the group. In the legal industry, when an attorney fails to adequately represent his or her client, he or she may be liable to the client for damages under a theory of negligence, otherwise known as legal malpractice. Legal malpractice is the failure to provide a professional level of service expected of a licensed attorney. Some examples of legal malpractice include a failure to communicate with a client, a failure to properly manage a case, a failure to make appropriate or timely filings, or in some severe cases, client abandonment. If you feel your attorney is not living up to your expectations, you should first contact him or her and explain your frustration. If your attorney is unresponsive, you may consider speaking with either your state bar representative or with another attorney who accepts legal malpractice cases.
