Common Law Marriage

Full Video Transcript

Do you know what a common law marriage is? It’s a unique type of relationship that differs from a traditional marriage. A common law marriage occurs when a couple lives together for a significant period and presents themselves as married, without a formal ceremony or license. In some states, a common law marriage grants similar legal rights as a traditional marriage, such as property and inheritance rights. Additionally, common law marriage may not provide all the benefits of a traditional marriage, like automatic spousal benefits or recognition in every state. Only a handful of states recognize common law marriages anymore. If you have a valid common law marriage and move to a state that does not recognize them, your marriage is still valid, but it may be difficult to prove that you are legally married.
