When parents live in different states, custody disputes can be very challenging. One of the first issues to resolve is figuring out which state court will hear the custody case. All states have enacted the Uniform Child Custody Jurisdiction and Enforcement Act, which sets forth the guidelines for determining which state’s court has the power to make and modify custody determinations. The uniform law, however, does not set forth the standards for how custody and visitation matters will be decided. Deciding which state’s court should hear the case depends on a variety of factors and may take into consideration the child’s home state, where the child has significant connections like schooling and family members, and whether any emergency exists to hear the case in a particular state.
