Overview of the West Virginia Court System

The West Virginia circuit courts are divided into 31 circuits spread across the state's 55 counties. These courts handle civil and criminal cases, as well as appeals from the magistrate courts. The magistrate courts are the lowest level of court a person deals with, which is why they are often known as the “people's court.”

West Virginia also has separate family courts, which deal with issues involving children and marriage. There are 27 circuits with these family courts and 47 judges who hear those cases.

Unlike most states, West Virginia does not currently have an intermediate appellate court. All appeals from the circuit courts are handled by the Supreme Court of Appeals of West Virginia, the highest court authority in the state.
