Can a Lender Sue a Borrower for a Deficiency Judgment if the Lender is Still Owed Money After a Foreclosure Sale in California?

A lender may only sue a borrower to obtain a deficiency judgment if the lender originally sued the borrower to obtain a judicial foreclosure. If the lender sought a non judicial foreclosure sale, as most California lenders do, then there is no right to sue a borrower for a deficiency judgment.
