Attorney John L. Bertoldo

John L. Bertoldo is a highly accomplished and skilled Las Vegas personal injury attorney and a partner at Bertoldo, Baker, Carter, Smith & Cullen.

John grew up in a large family and had a strong argumentative streak. His mother turned that into a positive by telling him, “As much as you like to argue, someday you’ll be a great attorney!”

Since then, John knew he wanted to be an attorney. Every step of the way—on his two-year mission to Italy, while attaining his joint J.D. and M.B.A. from Brigham Young University, and when he began practicing law in 1985—John drew on his mental toughness to fulfill his dream. He’s been the managing partner at Bertoldo, Baker, Carter, Smith & Cullen since 1992.

John has always devoted his practice solely to plaintiffs’ personal injury, speaking up for clients who otherwise would be intimidated, cheated, or taken advantage of by insurance companies. John enthusiastically fights on behalf of the injured, especially for those embroiled in serious trauma, brain injury, and wrongful death cases. He has helped thousands of people through some of the most difficult and challenging times in their lives.

“We have lifelong friends who’ve been clients. When I see them, I don’t get a handshake. I get a bear hug,” says John.

Attorney Brett A. Carter

“No person should be above the law, and no person should be below the law;” Theodore Roosevelt said it, and Brett Carter lives it. From his earliest years, Brett saw the power of standing up against adversity in the struggle for justice. His father served in the Air Force as a Judge Advocate General. Because his family moved around so much, Brett was the perennial “new kid,” an automatic target for bullies. Because of this, his favorite story is David vs. Goliath, where skill and faith can win against overwhelming odds.

Brett earned his undergraduate degree in business administration from UNLV before going on to receive his Juris Doctor from Willamette University School of Law. In 1996, he joined John Bertoldo in practice and immediately devoted himself to the practice of personal injury and wrongful death law. Those who have suffered traumatic spinal and head injuries, who have lost limbs, who have endured disfigurement, disability and chronic pain, have found their advocate in Brett.

Determined to help his clients to the best of his ability, Brett took his fascination with medicine and used it to learn about the best medical providers and treatments for each type of injury. He considers his drive and ability to outwork his opponents a necessary asset. And, beyond all that, beyond the science and the law, he comes to know his clients as people—concerned, overwhelmed, frightened, hurting physically and financially, on a journey they didn’t choose—and comes to see them as family. As Brett tells his clients, “We’re in this together.”

This effort and commitment to go the extra mile (and then some) led Brett to Ironman competitions and ultra-long distance mountain running. To Brett, nothing worth attaining comes without struggle. And nothing is more satisfying, life-affirming, and inspiring than hitting the finish line, especially when the finish line means achieving justice for his clients and their families.

Attorney Lawrence J. Smith

To Lawrence J. Smith, there’s only one way to do things: the right way. Growing up in a small town in Ohio, where everyone knew everyone else, a handshake was a contract. You always did your best, you treated your neighbor the way you wanted to be treated, and you never, ever went back on your word. “We all have a contract with each other to act reasonably,” he explains, “and when that’s broken, you have to make things right.”

Those principles have guided Lawrence his entire life. They took him into the Air Force, where he could spread his wings (so to speak) and serve his country. He completed his military service here at Nellis AFB and decided Las Vegas—still a small town in 1977—would be his home. He graduated summa cum laude from UNLV, receiving his B.A. in criminal justice. He then went to Baylor School of Law to earn his Juris Doctor with an emphasis in civil litigation.

Lawrence came back home armed with the determination, ethics, and skills to ensure justice for injured clients. He went straight into practice with John Bertoldo and has never left. Every moment of his law career has been spent working as a plaintiffs’ attorney in personal injury and product liability cases. Every day, he wades into battle against insurance companies.

Lawrence is a force of nature in the courtroom, and has been trial counsel in multiple cases that resulted in multimillion-dollar verdicts. He is a fighter, a believer in right over wrong, because, to him, a company that refuses to take responsibility for their actions has broken a contract—and that just won’t fly.

Attorney Lindsay K. Cullen

Every day, Lindsay Cullen sees clients in the midst of their greatest challenges, facing daunting adversity. She believes it’s her job to guide them and help them regain their strength. A lifelong athlete, Lindsay developed qualities playing sports that carry through to her law practice today. She is driven by hard work, strength, commitment, and sheer fight, able to do feats that look impossible to the rest of the world.

Lindsay is a graduate of the University of Nevada, Reno, where she earned a B.A. in criminal justice with highest distinction honors. Prior to law school, Lindsay worked for the Founder of eBay, as well as the former Governor of Nevada, the late Kenny Guinn.

Lindsay earned her Doctor of Jurisprudence from Golden Gate University, School of Law in San Francisco, California. After passing the California Bar, Lindsay moved to Nevada with her husband Paul. While studying for Nevada’s Bar exam, she took a position with a plaintiff personal injury law firm and found her passion in helping others.

Lindsay has dedicated her law practice to representing those who have experienced injury or loss as a result of the carelessness of others. Through tireless advocacy, she has successfully represented individuals and their families in serious personal injury, medical malpractice, wrongful death, premise liability, and product defect cases.

In 2013, Lindsay joined Bertoldo, Baker, Carter, Smith & Cullen, where she continues to take on challenges and fight for justice. She knows she cannot undo the traumas her clients have been through, but she can change their outcomes by standing up, taking challenges face-on, and advocating for those with a quiet voice—or no voice at all.

Attorney Javier A. Arguello

Honesty; hard work; responsibility and resilience—these are the qualities Javier Arguello embodies, and he learned all of them growing up. At age three, Javier was brought to America from Ecuador. His mother’s work ethic affected him deeply, and he refused to settle for less than his own best, earning his B.A. from the University of Southern California. His decision to go into law was driven by his mother, as well, but in a more personal way. She had been the victim of a work accident. She endured pain, suffered indignity, and at the end of a demoralizing process, received an unfair and inadequate settlement.

Javier received his Juris Doctor from Santa Clara University. Drawn to workers’ compensation law, he has worked for insurers and employers. He’s represented all areas of the construction industry, municipalities, grocery and department stores, hotels and casinos, transportation companies, and health care organizations. He has worked in private practice and as Chief Counsel for the State Industrial Insurance System, where he successfully argued cases before the Nevada Supreme Court.

During his time in insurance defense, Javier learned how insurance companies think, how they act, and what makes them tick. He brought his perspective and experience to Bertoldo, Baker, Carter, Smith & Cullen in 2006, where he now heads the workers’ compensation department, representing injured workers against those same insurance providers he once defended.

Javier is devoted to his clients. He is the one his clients meet with, he’s the one at court, and he’s there every step of way from beginning to end. He is always straightforward with his clients, offering clear and honest communication and consistent updates on the progress of their cases.

Attorney Paul R.M. Cullen

At Bertoldo, Baker, Carter, Smith & Cullen, Paul R. M. Cullen often sees clients on their worst days. More than just knowing the law, he believes his job is to comfort, educate, and advocate for those who are unable to advocate for themselves. That’s when the real work begins.

Paul grew up in Montreal, Canada. After graduating high school in Montreal, Paul continued his schooling in the United States. He graduated from Lake Forest College in Illinois, earning a B.A. with a double major in business and international relations. Paul then attended Golden Gate University School of Law in San Francisco, California, where he met his wife Lindsay. After passing the California Bar, Paul and Lindsay moved to Nevada.

Following his admission to the Nevada Bar, Paul began his legal career representing individuals greatly impacted by the financial crisis. He assisted hundreds of clients struggling with debt, as well as those who were underwater on their homes. Paul knew early on that helping people and families was how he wanted to dedicate his law practice.

After several years of helping those suffering from the financial crisis, Paul transitioned to personal injury law, where he refocused his dedication and passion for helping others to assisting those who were harmed because of someone else’s negligence. He loves giving his clients a voice and fighting for their rights. In 2017, Paul joined Bertoldo, Baker, Carter, Smith & Cullen.

To Paul, the best part of being a personal injury attorney is helping his clients recover from the injuries and losses they have suffered—and bringing a smile back to their faces.

Attorney Jim Sweetin

Jim Sweetin earned his undergraduate degree in business administration and accounting from UNLV before going on to receive his Juris Doctor from Gonzaga School of Law in 1993. He subsequently joined the Clark County District Attorney’s Office where he worked for 28 years. Over those years he spent virtually every day in a courtroom and sought justice for countless victims. Known as one of Clark County’s most zealous advocates for the protection of victims, Jim co-founded and serves as Chairman of both the Southern Nevada Children’s Advocacy Center and the Southern Nevada Sexual Assault Review Team. To this end, Jim successfully completed more than 100 jury trials. He was the Chief Deputy District Attorney in charge of the Special Victim’s Unit, which prosecutes the most serious of criminal offenses committed in Clark County, for over 13 years.

After leaving the District Attorney’s Office, Jim joined Bertoldo, Baker, Carter, Smith & Cullen where he continues to fight for victims. His goal is to even the playing field between ordinary people who have been wronged and large insurance companies or corporations who employ attorneys charged with minimizing responsibility or compensation for those wrongs. Jim owes his success in the law to meticulously building a case, always seeking to work harder than the other side, and never losing site of what is most important in any lawsuit - the harm or damage caused to a victim. Jim is most comfortable in the courtroom and anxious to proceed there if a wrongdoer fails to accept responsibility and adequately compensate a victim.
