Mark W. Mathys and Mark T. Schneid recently obtained a $7,250,000 settlement for their client in a failure to diagnose a medical malpractice case in Cook County, Illinois.
$6,063,115 Illinois Jury Verdict — Truck/Motor Vehicle Collision Lawsuit
Two teenage passengers were riding in a vehicle when it was broadsided by a semi-tractor-trailer. Both teenagers suffered closed head brain injuries. After the trucking company refused to settle the case, a jury verdict was entered against the trucking company in favor of the teenage boys. The million-dollar award was one of the largest verdicts in the history of DuPage County, Illinois, a historically conservative county.
$5,000,000 Settlement – Medical Malpractice – DuPage County (2019)
Our 74-year-old client who presented to the emergency room for severe pain in her upper legs from no known cause. Mathys & Schneid filed suit against a well-known St. Louis-area hospital and its physicians for their failure to timely diagnose the signs and symptoms of acute stroke from a dissected internal carotid artery condition in a 25-year-old mother of two resulting in over 13 hours of unnecessary delay in providing her with standard medication treatment that prevents subsequent debilitating strokes. As a result of the unnecessary delay, the patient suffered a very large debilitating stroke that caused hemiparesis in her arm and injury to her brain causing her to be unable to work in the future. Mathys & Schneid retained nine nationally renowned experts and used sophisticated technology to maximize a very favorable settlement for the client shortly before trial was to begin.
$2 Million Settlement — Fatal Truck Accident
Mathys & Schneid obtained a $2 million settlement recovery for a family whose two children were killed in a crash involving two semi-tractor-trailers on I-57 near downstate Effingham, Illinois. A semi-truck merged from the shoulder onto the highway at roughly 30 mph directly in front our clients who were traveling at 62 mph in the right highway lane. Our clients were riding with their three children in their own semi-truck. The semi-trucks collided in a massive impact and two children (age 8 and 5) were ejected and died at the scene. We hired two of the best accident reconstruction expert engineers in the country to determine how the crash occurred and the case was won using the data from the trucks' electronic control module (ECM). The ECM data proved how fast the trucks were going before impact and showed that the other driver was driving too many hours in violation of the Federal Hours of Service Regulations. The case settled at a pretrial settlement conference with a prominent judge in the U.S. District Court, Southern District of Illinois, well before the trial was scheduled to start.
$1.7 Million Settlement — Infant Wrongful Death From Dangerous Prescription Medication
Mathys & Schneid obtained a $1.7 million settlement for a family whose 2-month-old son died due to side effects of a prescription medication that was prescribed by his pediatrician in Kane County, IL. After a brief hospitalization, the pediatrician wrote a prescription for medication to be taken at home. The parents took the written prescription to a local retail pharmacy where the pharmacist dispensed a version of the prescription medication that contained different active ingredients than the intended medication. The dispensed prescription medication was never proven to be safe and effective and was never approved by the FDA for sale in the U.S. The active ingredients in the dispensed prescription medication caused the infant's death. Mathys & Schneid worked with multiple high-profile expert witnesses who were dedicated to the truth in the case, including a nationally recognized forensic toxicologist, forensic pathologist, pediatrician, pharmacist, FDA regulatory consultant and a psychologist specializing in family grief counseling. The case settled two months before trial.
$1,362,499 Jury Verdict — Medical Malpractice Lawsuit
In Louisville, Kentucky, a jury found in favor of Micheatria Donelson, represented at trial by Mark W. Mathys, with the help of local counsel. Five years after her son's decapitation, the jury awarded nearly $1.4 million to Ms. Donelson for pain and suffering. Ms. Donelson still suffers from post-traumatic stress disorder (PTSD), anxiety and depression as a result of this horrific event. Prior to delivery of the child, the evidence showed that the baby's legs were kicking but stopped before the doctor arrived. Unfortunately, because the baby boy was only 21 weeks old and not viable, he was not entitled to any independent recovery for wrongful death under Kentucky law. Local and national news outlets followed the entire case closely.
$1,360,000 Settlement - Automobile Collision – Kane County (2017)
On January 3, 2014, our client, a 59-year-old woman, was driving southbound on Illinois Route 47, north of Bahr Road near the railroad tracks in Rutland Township. The defendant driver was travelling northbound on Route 47 when he lost control of his pickup truck while going over the railroad tracks, crossed over the center line, and caused a vicious head-on impact to our client's car. The defendant driver was working for his employer at the time of the crash, so his employer was also responsible for the crash. On January 14, 2020, Mark W. Mathys and Colin Diamond obtained this jury verdict on behalf of their client, a 65-year-old woman. The defendant doctor negligently prescribed an antibiotic, Clarithromycin, knowing that our client was already taking Simvastatin (a statin drug), despite the fact that the combination of the medications was contraindicated and known to increase the risk of rhabdomyolysis, a serious condition that can cause severe muscle breakdown, kidney failure and even death. As a result, the rhabdomyolysis left our client with some permanent deficits including muscular weakness and fatigue in her legs that limits many aspects of her life.
