Under various state and federal laws, employers are legally required to pay eligible workers for overtime pay. The law can sometimes be complex and employers sometimes try to get around the law by paying workers a periodic fixed amount like a set pay each week. This doesn't necessarily mean the worker is salaried and exempt from overtime laws. And by law you cannot waive your overtime rights. If you've worked overtime and aren't considered a legally exempt worker, you may be owed back pay for the overtime hours you worked. You may be able to start the process by either filing a wage claim with your state Labor Department or filing a lawsuit against your employer for overtime pay and possibly plus interest and penalties.
