If you have not received equal pay for equal work then you should be aware of the Lily Ledbetter Fair Pay Restoration Act that was signed into law in January 2009. The law makes clear that your time frame for filing a complaint or a lawsuit under the Equal Pay Act starts over every time you receive a paycheck that is for less than equal pay. In 2007, the Supreme Court ruled that an employee’s rights under the Equal Pay Act are triggered by the employer’s discriminatory decision to pay employees who perform substantially the same work differently. The Lily Ledbetter Fair Pay Restoration Act does away with that Supreme Court decision. It may take time for employees to realize that they are being paid differently than others and the law now provides employees with that time by declaring each and every discriminatory paycheck a separate discriminatory act. The law applies to paychecks received since May 28, 2007.
