When we’re sick we often turn to prescription medications to relieve our symptoms. The last thing we expect is for the drug we’re taking to make us sicker, especially if we develop an illness not listed as a potential risk. When a drug causes harm to someone, and that harm is not listed as a side effect of the drug, the person who took the drug may be entitled to compensation. Fosamax, a drug manufactured by Merick to treat osteoporosis and Paget’s disease, was ordered by the FDA in 2004 to remove all misleading statements from its advertising and marketing materials. Additionally, the FDA urged Merick to change the labels on Fosamax to better warn patients of known side effects. Although Merick eventually changed its warning labels, you may still be entitled to compensation if you took Fosamax and later developed osteonecrosis of the jaw, or dead jaw syndrome.
