Lawsuits happen for many reasons, and for Depakote, there have been several types of lawsuits against the drug manufacturer Abbott Laboratories. Perhaps the most well-known lawsuit occurred in 2012 when Abbott was declared responsible and made to pay over 1.6 billion dollars for fraudulently marketing the drug as treatment for schizophrenia, autism and other off-label uses.
Other lawsuits are being filed by victims of Depakote who claim Abbott Laboratories caused severe birth defects in their children. These lawsuits allege Abbott knew or should have known their drug could cause birth defects, yet failed to adequately warn the public regarding this danger.
