If you’re in policy custody and not free to leave, it means you’re probably in a custodial situation. In order for anything you say during a custodial interrogation to be used against you, the police must advise you of your Miranda rights, including the right to remain silent and the right to have an attorney present. In a police interrogation, the police ask questions in order to get you to disclose important and incriminating information that might help them in their investigation. Where the issue can get complicated is when a police officer is talking to you, but you’re not sure if you’re in custody. They key is generally whether you are free to leave. If the police have not advised you of your rights when you’re in custody, then whatever you tell them may not be admissable against you.
