California Civil Code Section 1951.4 allows renters to sublet or assign their lease to another party unless it is forbidden in the lease. With a sublet the landlord is not a party to it and the original renter is still responsible to the landlord for the full rent. In an assignment the new tenant becomes directly responsible to the landlord for the payment of rent. For this reason many leases prohibit sublets.
