My Neighbor And I Share A Fence, But It Is In Terrible Shape And Their Animals Are Always On The Loose. What Can I Do About It?
Generally speaking, all shared fences must be well maintained, and kept in good repair. If there is a controversy over the shared fence, you have several options to choose from. First, you may ask for help from disinterested third parties called fence viewers. Fence viewers consist of three people, one person chosen from each side, and a third person elected by the two already chosen. Fence viewers may look the situation and assign to each party their rights and duties to maintain the fence. Another option for the complaining party is to simply repair the fence, and ask for the repair money later. To do so, the complaining party must ask the fence viewers to inspect the fence and demand a proportionate sum from the other party.
