Every complaint is reviewed by staff members with medical, legal, investigative and public health knowledge. This group of staff members then decides whether the complaint should be formally opened or whether it should be dismissed. If it is decided that the complaint should go forward then a copy is typically provided to the doctor. The doctor has thirty days to issue a written response. The Board may conduct an additional investigation if it deems it to be necessary. Then, the information from the complaint, the doctor and other investigative materials are provided to the Compliant Committee. The Complaint Committee can dismiss the case, request additional investigation, issue a letter of advice or concern to the doctor or recommend that the full Board hear the case. If the Board hears the case, the doctor is entitled to due process of law and a full administrative hearing. The Board can take formal disciplinary action against a doctor at the completion of a full hearing.
