All foreclosures of North Dakota property occur with judicial involvement. A lender must sue the borrower to obtain a foreclosure. If the court issues a decree of foreclosure then a foreclosure sale may proceed and it is the responsibility of the clerk of the court to advertise the foreclosure sale. State law does not include information about how the clerk of the court must advertise the foreclosure sale.
