What Public Notice Requirements are There for a Real Estate Foreclosure in Michigan?

If the lender pursues a court ordered foreclosure sale in Michigan then the court will issue a Notice of Sale and it must be publicized according to the court’s terms.
However, if the lender pursues a non judicial foreclosure then the lender must publish a Notice of Sale in a county newspaper each week for four consecutive weeks prior to the sale. The Notice of Sale must also be posted on the property within 15 days of the first publication date.   If the sale is postponed for less than one week then a Notice of Postponement must be posted on the property indicating the revised date and time of the sale. However, if the sale is postponed for more than one week then all of the 4 consecutive weeks of newspaper publications must be repeated. Individual mortgage agreements can modify the public notice requirements.
