Can I Keep My Home If I File Bankruptcy in Kansas?
Kansas has one of the most generous homestead exemption laws in the country. In Kansas, all of the equity is exempt on up to 160 acres of farming property or up to 1 acre of property in a municipality or the value of a mobile home. Given the unlimited dollar amount for the homestead exemption, a bankruptcy court is likely to allow a borrower to remain in the home so long as the borrower is not in default on the mortgage and is able to continue making payments on the property.
