What Public Notice Requirements are There for a Real Estate Foreclosure in Georgia?

Georgia law permits both judicial and non judicial foreclosures depending on the terms of the mortgage contract. In a judicial foreclosure, public notice is provided when the lender files a complaint in state court.
In a non judicial foreclosure, the lender must publish a Notice of Sale in the local newspaper for at least 4 consecutive weeks prior to the sale.
