In Colorado, Can a Spouse Give Up His or Her Right to Alimony in a Premarital Agreement?
Yes, Colorado law allows spouses to include modification or elimination of spousal support in their prenuptial agreement. However, the terms of the spousal support agreement may not be unconscionable at the time of enforcement. If the Court determines that the spousal support portion of the premarital agreement is unfair at the time of enforcement then it can order that spousal support be paid even if the premarital agreement was fairly and properly executed.
