Not every contact between an officer and his supervisor is an interrogation subject to POBAR. It does not apply to an interrogation in the normal course of duty, counseling, instruction, or informal verbal admonishment by, or other routine or unplanned contact with a supervisor or other officer. Matters are considered on a casebycase basis. When analyzing any circumstance, it is important to remember that POBAR coexist with other public sector labor laws. These public sector laws have provisions that are similar to the National Labor Relations Act. Included in this is the right to representation.
