Under The Pobar Act Can An Officer Be Re-Assigned During An Investigation?

An officer can be temporarily reassigned as long as other officers normally would be treated the same and given such an assignment under similar circumstances. Thus, it may not be a violation of POBAR if an officer being investigated regarding a shooting were temporarily assigned to deskwork. However, if the officer can demonstrate that such treatment was abnormal for officers in similar circumstances, it may be a violation.
