Writs and appeals are a part of both the criminal and civil justice systems. Writs provide special powers or make special demands. In the days when our Constitution was being drafted, they were a more common way to frame an issue or request action by a court. An appeal of course is a very common feature of our justice system and occurs frequently in both civil and criminal cases. Writs and appeals are based on briefs, motions and oral arguments.
