Real estate litigation is litigation related to buying, selling, developing and managing real estate. In addition, this category of litigation can involve issues relating to governmental actions like eminent domain and government regulation such as environmental law. Real estate litigation can be quite complex. A qualified real estate litigation attorney must have a deep knowledge of real estate transactions and also ancillary issues relating to business agreements, estate planning and tax law at times. Litigation involving real estate would typically be civil litigation, though it could at times involve criminal conduct in terms of violating federal or state law. Also, real estate litigation often can involve so-called torts cases, such as where a person is injured on land owned by another person and is suing for damages.
