SUCCESSES:
- Construction accident. Plaintiff fell off
ladder while carry roofing material to the roof. Defendant's
interposed a "recalcitrant worker" defense claiming that plaintiff
failed to use a hoist that was available to him. Plaintiff was
awarded a directed verdict at the close of his case on liability.
Plaintiff sustained a fracture to his tibia plateau requiring open
reduction and internal fixation. Jury awarded
$5,857,910.00 of which $2 million represented pain
and suffering and the remainder for economic loss and medical
expenses.
- Trip and fall on stairs. Plaintiff tripped and
fell on a painters rod left on the stairs of her apartment
building, sustaining a torn meniscus requiring knee surgery.
Defendant disputed that the rod belonged to him. Jury found for
plaintiff and awarded approximately $1.3
million.
- Auto accident. Plaintiff, an off duty police
officer on his way to work, was injured while rescuing an injured
motorist from a car accident. Plaintiff required surgery for his
back injury. It was found that the person who caused the accident
created a dangerous condition which invited a rescue and was
consequently responsible for the injuries sustained by the person
performing the rescue. After trial, a judgment was entered for
approximately $450,000.00 on the injured officer's
behalf.
- Automobile accident. Plaintiff was injured
while guiding a truck onto a loading dock. The truck while backing
up struck a dumpster which struck the plaintiff fracturing his hip.
Plaintiff was awarded $425,000.00
- Car wreck. Plaintiffs were passengers in a car
that was driven off the road. One sustained a fractured arm and the
other plaintiff an ankle fracture. Plaintiffs recovered
$380,000.00
