Colorado Drunk Driving:

In the state of Colorado, it is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle. For persons under 21, it is even less.

In order to be convicted of drunk driving, the prosecution must prove that the defendant was driving or possessed actual physical control of a vehicle while his or her ability was impaired or he or she wasu nder the influence of drugs or alcohol. Evidence must show that the arresting officer had a reasonable, articulable suspicion for stopping or approaching the vehicle, or if stopped at a roadblock, that the roadblock was set up in accordance with the Fourth Amendment to the U.S. Constitution.

DUI:

“DUI” stands for Driving Under The Influence and occurs when someone is operating, or is in actual physical control, of a motor vehicle while under the influence of alcohol or drugs to such a degree that the driver was substantially incapable of safely operating a motor vehicle. A person is presumed to be driving under the influence with a blood or breath test over .08. Even for a first offense, penalties can include license suspension, substantial fines, community service, mandatory attendance at an approved alcohol program and jail.  In addition, a DUI conviction typically results in higher insurance premiums and could also jeopardize your employment opportunities.

DWAI:

DWAI stands for Driving While Ability Impaired and occurs when someone is operating or is in actual physical control of a motor vehicle after consuming alcohol and or drugs such that you were less able than you ordinarily would be, even to the slightest degree, to drive the vehicle with safety to yourself and to the public. A person is presumed to be driving while ability impaired with a blood or breath test over .05 but under .08.

Vehicular Assault

If someone was injured as a result of the drunken driving accident, it is possible the defendant will be charged with a felony (and if the victim dies, the driver may be charged with vehicular manslaughter). Driving with a Suspended/Revoked License:

Driving with a suspended or revoked license in Colorado is considered a crime and can result in heavy fines and possible jail time. The penalties are typically heavy if the license suspension or revocation was the result of alcohol related. In addition, the suspension or revocation may be extended by DMV.

Driver’s License Revocation:

If your blood or breath test result was .08 or higher, you may be facing a revocation of your driver’s. If you received a Notice of Revocation your license while be revoked unless you request a DMV hearing, This request must be made within 7 days. When you request the hearing at a DMV office, you will be issued a temporary permit. This permit is good until the hearing or 60 days, whichever comes first.

At the hearing, it must be established that there was a reason to stop you and request a chemical test and that the test was done within 2 hours with a result over .08. If this is your first revocation, your license will be revoked for 3 months. You may ask the hearing officer for a probationary license (for restricted driving) which lasts for 5 months, but you must serve 1 month with no driving. If this is not your first revocation, your license will be revoked for 1 year.
