And the results speak for themselves: Verdicts and Settlements Chronic Fatigue Syndrome: Kantor & Kantor represented a cameraman suffering from chronic fatigue syndrome, which rendered him unable to perform the duties of his occupation. His claim was denied by his disability insurer, without having conducted any meaningful investigation of the claim. Kantor & Kantor filed a lawsuit on his behalf, achieving early victory without a trial when the Court granted their motion for summary judgment. Settlement: $900,000.00 Fibromyalgia & Chronic Fatigue: The insurance company (Paul Revere) approved an application for long-term disability benefits, but did so under the "Other Limitations" provision in the policy. The net effect was to limit the benefits to a maximum of 24 months. The client suffered from fibromyalgia and chronic fatigue – conditions not subject to the 24-month limitation. The client filed an administrative appeal of the decision, but the appeal was denied. Kantor & Kantor filed a civil action in Superior Court, vigorously pursuing the case all the way through trial of the case, whereupon judgment was entered in favor of the Claimant (client). The insurance company was ordered to resume payment of long term disability benefits in accordance with the policy, without the 24-month time limitation. Fibromyalgia: Kantor & Kantor represented a woman so disabled by fibromyalgia that she was unable to perform her duties as a Customer Care Advocate. After several short-term disability leaves, the woman filed for long-term disability benefits. Ignoring reports from her doctor documenting the disability, her claim was denied. Her appeal of the decision included additional medical reports and statements from family members and friends describing her deteriorating physical condition. However, her claim was still denied. Kantor & Kantor sought and obtained a de novo review of the claim denial. The Court overruled the administrative decision and entered a judgment requiring the defendant to pay long-term disability benefits. The defendant was also ordered to pay plaintiff’s attorney fees. Life Insurance: A widower filed a claim under a $150,000.00 life insurance policy after the death of his wife. When the insurance company refused to pay more than $20,000.00 under the policy, Kantor & Kantor filed a civil action against the insurer, alleging that all premiums had been timely paid and that all information requested by the insurer had been provided. The Court granted the claimant’s motion for summary judgment, requiring the insurance carrier to pay more than $150,000.00, including attorney fees.
