Attorney David Stoller

David Stoller is the founder of our firm. He is a graduate of the University of Michigan (Bachelor of Science 1992) and the Nova Southeastern University College of Law (Juris Doctor, cum laude, 1996). Mr. Stoller is the current Immigration Court and Office of the Chief Counsel Liaison for the American Immigration Lawyers Association (AILA), Central Florida Chapter. Mr. Stoller is also a frequent lecturer and speaker for national & regional AILA conferences and has spoken locally before the Central Florida Association of Criminal Defense Lawyers and the Orange County Bar Association.

Prior to entering private practice, Mr. Stoller was an Assistant District Counsel with the legacy Immigration and Naturalization Service (now Immigration and Customs Enforcement). In this capacity, Mr. Stoller protected the federal government's interests before the United States Immigration Court and the Board of Immigration Appeals. Mr. Stoller provided legal advice to the operational components of the legacy Immigration and Naturalization Service, including Immigration Agents, Immigration Inspectors, Deportation Officers, and District Adjudication Officers.

During his tenure with the Immigration and Naturalization Service, Mr. Stoller handled thousands of cases dealing with individuals who appeared before the Court seeking benefits such as political asylum, waivers of past criminal activity and permanent resident status in the United States. He worked in the District Criminal Alien Program and traveled to county jails, state prisons, and other detention facilities to handle deportation proceedings conducted while individuals were incarcerated. Mr. Stoller was also involved in worksite enforcement, handling cases dealing with employers who violated immigration laws by providing employment to unauthorized individuals.

Since entering prívate practice in 1999, Mr. Stoller has represented hundreds of individuals before Citizenship and Immigration Services, the Immigration Courts, the Board of Immigration Appeals, Embassies and Consulates worldwide, and before the federal courts (United States District Courts and United States Courts of Appeal). Utilizing his significant government experience for the benefit of his clients, Mr. Stoller has developed a successful boutique immigration practice serving Central Florida and clients worldwide.

Due to his proficiency in all immigration matters, and areas relating to criminal law in particular, other attorneys often seek Mr. Stoller’s advice on the immigration consequences of criminal offenses and plea agreements. He has successfully obtained immigration waivers of criminal offenses and cancellation of removal benefits on behalf of permanent resident aliens who have had past transgressions with the law. Mr. Stoller also assists individuals who have immigration holds placed against them in moving their cases forward by contacting the appropriate authorities or suing in federal court if necessary. Mr. Stoller has obtained immigration bonds for qualified individuals and assisted others in speeding their deportation process when it is their desire to be removed from the United States as quickly as posible. He has successfully presented asylum claims for immigrants from countries throughout the world, including many cases initially denied by Citizenship and Immigration Service and referred to the Immigration Courts.

Mr. Stoller maintains a busy federal court practice, bringing numerous actions in federal court in an effort to move stalled cases along. In this regard, Mr. Stoller has successfully handled dozens of cases in which he has sought the assistance of the United States District Courts in ordering the immigration authorities to do what they otherwise will not do. This has included obtaining decisions on applications for residency and naturalization along with resolving problems relating to work permits and the issuance of alien registration cards. In addition, Mr. Stoller has argued before the Eleventh Circuit Court of Appeals in both Miami and Atlanta and before the Sixth Circuit Court of Appeals in Cincinatti. Mr. Stoller’s published cases include Lenis v. U.S. Att’y Gen., 525F.3d 1291 (11th Cir. 2008); Niftaliev v. U.S. Att’y Gen., 504 F.3d 1211 (11th Cir. 2007); and U.S. v. Salman, 378 F. 3d 1266 (11th Cir. 2004), 266 F.Supp.2d 1367 (M.D. Fla. 2003).

Mr. Stoller’s benefit related immigration practice assists clients in obtaining immigrant and nonimmigrant visas based on their extraordinary or exceptional abilities, outstanding educational attainment, or their relationship with employers or family members. Mr. Stoller has obtained permanent residency for countless individuals petitioned for by family members, petitioned by employers and on behalf of those eligible to self-petition. He has experience with all immigrant and nonimmigrant visas categories and has handled complicated cases assisting individuals to return to the United States after deportation or after receiving criminal convictions.
