Attorney David Jaroslawicz, Principal Partner
David Jaroslawicz, the principal partner of Jaroslawicz & Jaros, is a member of the New York, Florida and California bar. He has been in practice for over 38 years and has been selected as one of the Top Trial Lawyers in the country by The American trial Lawyers Association.
Mr. Jaroslawicz has handled both trials and appeals and has argued before the United States Supreme Court, the New York State Court of Appeals, the United States Court of Appeals for the Second, Ninth, and Tenth Circuit, as well as the Florida Supreme Court. Mr. Jaroslawicz has represented countless clients involved in commercial litigation; contract disputes; real estate litigation; sexual discrimination and harassment, sexual abuse by priests, medical malpractice; product liability cases such as defective medical products, pharmaceuticals, bicycle or motorcycle helmets, industrial machinery, tires, hospital equipment, and defective automobiles, among others.
His contributions to the practice of law have helped shape New York and New Jersey common law. In fact, Mr. Jaroslawicz was among the legal pioneers who developed the concerted action theory that was utilized against drug manufacturer Eli Lilly Pharmaceuticals, who had manufactured and sold DES, a drug that caused cancer in children decades after their mothers had ingested the drugs while pregnant. In addition to his work in the personal injury field, Mr. Jaroslawicz has also handled class-action consumer fraud lawsuits as well as lawsuits on behalf of stock holders who have suffered severe financial losses as a result of securities fraud.
Due to his expertise, Mr. Jaroslawicz had been invited to lecture on numerous occasions on behalf of lawyer groups such as the New York Trial Lawyers Association. Presently, Mr. Jaroslawicz is handling commercial matters on behalf of Tao Restaurant Group, Diamond Court Reporters, Next Modelling Agency, Baytree Capital, and Beatrice Inn.
Attorney Abraham Jaros, Co-Partner
Abraham Jaros, co-partner of Jaroslawicz & Jaros, is a seasoned and successful trial lawyer who began his career over 34 years ago, aggressively representing the rights of the indigent and poor while working for the New York Legal Aid Society. Mr. Jaros is extremely impassioned in representing the rights of the little guy against well-funded corporations and insurance companies.
He has tried hundreds of cases and won numerous multi-million dollar verdicts on behalf of his clients. Starting as far back as 1984 and 1985, Mr. Jaros won the first $1 million plus verdict in Sullivan County and $2 million verdict in Albany, both in medical malpractice lawsuits. In 1987 he won a $2 million dollar verdict on behalf of a model that had developed acne caused by face cream. During the next decade, Mr. Jaros continued to prosecute cases, securing the highest verdict ever in a Family Medical Leave Act case, and representing clients in cases involving medical malpractice, product liability, Jones Act/Maritime law, Labor law, automobile accidents, disability and life insurance disputes, premise liability, police abuse, foster care abuse, general personal injury matters as well as commercial litigation.
Attorney Natascia Ayers
Natascia Ayers, senior trial attorney for Jaroslawicz & Jaros, is a member of the bars of New York, Florida, Southern and Eastern District of New York, and Southern District of Florida, and is also a member of the American Trial Lawyers Association.
Since Mrs. Ayers began practicing law in 1995, she has secured several million dollar verdicts on behalf of her clients including $3 million in owed benefits on behalf of a paraplegic. She speaks Italian, French and understands Spanish. Mrs. Ayers is notable for keeping very close contact with her clients and handling many personal matters for them on a pro bono basis.
At present, Mrs. Ayers is concentrating her practice on medical malpractice, handling such cases as: brain damage sustained by babies during childbirth; Transfusion Related Lung Injuries; failure to diagnose cancer; improperly performed gastric bypass surgery leading to death; severe bed sores as a result of improper care by a nursing home or health aide; and emergency room negligence including failing to properly diagnose and treat critical medical conditions such as necrotizing fascitis, appendicitis, heart attack, and meningitis. Attorney Elizabeth Eilender
Elizabeth Eilender, (Of Counsel), one of the firm's senior trial attorneys, is a graduate of Dartmouth College and New York Law School and has been practicing law since 1992. She is a member of the state bars of New York, New Jersey and Connecticut and the federal courts of the Southern and Eastern Districts of New York and the District of New Jersey. Her diverse litigation practice has included representing well-known companies and high profile individuals in commercial disputes, breach of contract cases, defamation, medical mal-practice and discrimination matters.
Ms. Eilender litigated the first sexual harassment case in New York which determined that the Commodities Exchange was a place of public accommodation and therefore the New York Human Rights Law protected exchange members. She has successfully litigated denials of claims for life insurance and disability benefits against such insurance companies as UNUM Provident, Hartford and Metropolitan Life. Ms. Eilender is perhaps best known for having represented families who have suffered devastating property and real estate losses and illnesses from water and mold damage to their homes and offices. In the early '90s, as an associate for the firm, Ms.Eilender litigated one of the first toxic mold cases in the state of New York.
Due to her long-standing expertise and success in this field, she was requested to lecture at the New Jersey Institute of Continuing Legal Education regarding legal and technical aspects of prosecuting mold cases and was recently quoted in the Wall Street Journal.
Attorney David Tolchin
David Tolchin, a senior associate of the firm, is a 1998 graduate of Brooklyn Law School admitted to practice in the courts throughout New York State and in the United States District Court for the Southern and Eastern Districts of New York.
An experienced litigator and appellate counsel, Mr. Tolchin has argued motions and appeals at both the trial court level and in the Appellate Divisions of the New York Supreme Court in such diverse areas as medical malpractice, Labor Law, breach of contract, and automobile liability. As a litigator, Mr. Tolchin handles myriad cases in federal and state court, including 911 litigation, Warsaw Convention airplane accidents, unpaid overtime and wage claims, sexual discrimination in the workplace, Labor Law construction work accidents, medical malpractice, products liability, and pedestrian and automobile injuries. Attorney Jed Kirsch
Jed Kirsch has recently joined our firm as a senior trial associate. He has been representing injured parties for over 30 years in various legal matters with many successful settlements and verdicts. Mr. Kirsch brings his experience running a successful law practice for over fifteen years, together with a commitment to providing the best representation he can to the firm’s clients.
He is a graduate, with honors, of Binghamton University and Brooklyn Law School. He is a member of the New York State Trial Lawyers Association, the American Association for Justice and the New York State Bar Association.
Attorney Michelle Holman
Michelle Holman, an associate of the firm, is a 2007 graduate of Cardozo Law School and is admitted to practice in New York State and the Southern and Eastern Districts of New York.
Prior to attending law school Ms. Holman worked in the financial services industry and held several securities licenses, including Registered Representative (Series 7) and Registered Principal (Series 24). While at Cardozo she worked on the Securities Arbitration Clinic representing individual investors in actions against broker-dealers, as well as doing financial enforcement work at the NASD (now FINRA) and the Bureau of Securities of the New Jersey Attorney General’s Office. Presently Ms. Holman’s practice includes a wide variety of cases, including premises liability, property damage and personal injury actions.
Attorney Lloyd Kat
Lloyd Katz, associate attorney for Jaroslawicz & Jaros, is a member of the New York and Maryland Bars, as well as being admitted to practice before the Southern and Eastern Districts of New York, and is also a member of the New York State Trial Lawyers Association. Since Mr. Katz graduated law school graduated law school at the age of 22 and began practicing law in 1983 he has represented victims of accidents and medical malpractice with excellent results. Mr. Katz has secured a $1.5 million verdict on behalf of the family of a 15 year old boy who was not diagnosed with Rocky Mountain Spotted Fever by the doctors in Brookdale Hospital in time to save his life even though he should have been administered antibiotics. At present, Mr. Katz is concentrating his practice on medical malpractice, handling such cases as neurological damage sustained by a mother during childbirth, chemical burns during surgery, bed sores as a result of improper care by a nursing home and failure to diagnose meningitis in the emergency room.
