Having worked previously as a partner at a large firm and as a federal prosecutor, I understand the value of providing my clients with personal attention and premier service.  From 1990 to 2001, I worked in the San Diego office of Latham & Watkins, one of the most prestigious law firms in the world.   While there, I successfully represented major corporations in several landmark cases before the California Supreme Court and the Courts of Appeal.  I left Latham & Watkins in 2001 to serve as an Assistant United States Attorney.  As a federal prosecutor, I obtained criminal convictions in all 20 of my jury trials and was never overturned on appeal.

Verdicts & Settlements

Montrose Chemical Corporation of California v. Admiral Insurance Company (1994):  I successfully represented Montrose Chemical Corporation in a landmark insurance coverage case that led to the California Supreme Court’s adoption of a so-called “continuous trigger” of coverage for third-party liability policies.  

San Elijo Ranch v. County of San Diego (1997):   I successfully represented developer San Elijo Ranch in a case that resulted in the closure of the County-owned and operated San Marcos Landfill due to numerous environmental violations.  The resulting residential development has won numerous design awards.

FibroGen, Inc. v. Cellex-C International (2005):  FibroGen sued my client, Cellex-C, for licensing agreement violations pertaining to the design, sale and distribution of cosmetic skin care products.  Cellex-C’s previous attorneys had withdrawn because they regarded Cellex-C’s case as hopeless.  Nonetheless, we successfully overcame all of FibroGen’s contentions on summary judgment, and ultimately settled the case on highly favorable terms.

ViaSat, Inc. v. Federal Insurance Company (2006):  My client, ViaSat, sued its insurance carrier for wrongfully refusing to indemnify ViaSat for loss of business income and expense resulting from a failed satellite.  Following several rulings in our favor, the case settled.

United States of America v. San Diego Gas & Electric, et al. (2008):  My client, an environmental employee at SDG&E, was indicted in federal court based on several alleged criminal asbestos violations and alleged misstatements to government officials.  Following a seven-week jury trial, my client was acquitted of all charges except one, and that charge was subsequently dismissed based on improper government testing methods.  

RE Digital v. Kellen, et al. (2010):  An LED circuit board manufacturer sued my client, Faubion Associates, for unfair business competition, breach of contract, and other theories based on alleged trade secret misappropriation.  The court agreed with Faubion that RE Digital’s claims were preempted by the California Uniform Trade Secrets Act and granted summary adjudication.  The case subsequently settled on very favorable terms.
