You can be arrested for DUI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Hawaii DUI penalties:

First Offense

  • a fine of no more than $1,000.00
  • possible term of imprisonment of no more than 6 months
  • substance abuse evaluation
  • attend a victim's panel
  • license suspension for no more than 180 days

Second Offense

  • a fine of no more than $2,000.00
  • possible term of imprisonment of no more than 1 year
  • license suspension for no more than 1 year
  • mandatory ignition interlock
  • two years supervised probation

Third Offense

  • Felony conviction
  • a fine of no more than $5,000.00
  • possible term of imprisonment of no more than 5 years
  • license suspension for no more than 5 years
  • supervised felony probation
