Louisiana DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Louisiana DUI penalties:
First Offense
- a fine of no more than $1,000.00
- possible term of imprisonment of no more than 6 months
- participation in a alcohol or substance abuse program
- license suspension for no more than 90 days
- possibility of no more than 32 hours of community service
Second Offense
- a fine of no more than $1,000.00
- possible term of imprisonment of no more than 6 months
- participation in a alcohol or substance abuse program
- possibility of no more than 240 hours of community service
- license suspension for no more than 12 months
- ignition interlock device for no less than 6 months
Third Offense
- a fine of no more than $2,000.00
- possible term of imprisonment of no more than 5 years
- inpatient substance abuse program for 4 to 6 weeks
- out-patient substance abuse treatment for 12 months
- license suspension for no more than 24 months
