Michigan DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Michigan DUI penalties:
First Offense
- a fine of no more than $500.00
- possible term of imprisonment of no more than 93 days
- no more than 45 days of community service
- license suspension for no more than 2 years
Second Offense
- a fine of no more than $1,00.00
- possible term of imprisonment of no more than 1 year
- license suspension for no more than 2 years
Third Offense
- felony charge
- a fine of no more than $5,000.00
- possible term of imprisonment of no more than 5 years
- possible confiscation of vehicle
