Ohio DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Ohio DUI penalties:
First Offense
- a fine of no more than $1,000.00
- possible term of imprisonment of no more than 6 months
- license suspended for no more than 3 years
Second Offense
- a fine of no more than $1,500.00
- possible term of imprisonment of no more than 6 months
- license suspended for no more than 5 years
- 90 day impoundment of license plates
- 90 day vehicle seizure
Third Offense
- a fine of no more than $2,500.00
- possible term of imprisonment of no more than 10 years
- 180 day impoundment of license plates
- 180 day vehicle seizure
