Virginia DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Virginia DUI penalties:
First Offense
- a fine of no more than $250.00
- possible term of imprisonment of no more than 10 days
Second Offense
- a fine of no more than $500.00
- possible term of imprisonment of no more than 30 days
Third Offense
- a fine of no more than $1,000.00
- recieve a felony charge
- possible term of imprisonment of no more than 90 days
